Tax avoidance 

Governments may say they can stop tax avoidance, but there’s a limit to their ability to do so, in practice.

Aggressive tax avoidance is already well legislated for and HMRC get notice of all schemes before any tax is avoided.

They have chosen not to act on that information, probably because they’d lose in the courts.

As tax collection has become even more important, expect a more agressive approach from HMRC, including for very normal clients.

Often an easy win for HMRC with Umbrellas being targeted recently. 

The CEST to be used in advance can produce surprisingly helpful results, but, if not, we may need to remind clients that HMRC’s tool is biased and doesn’t have to be followed.
